TERMS OF SERVICE

By commissioning the Artist, the Client agrees to the following terms:

ENGAGEMENT
> Client needs to provide clear and complete requirements and expectations upfront, including reference materials or assets before a commission begins
> Client warrants that the character design, reference material, and other intellectual property provided to the Artist are legally obtained and authorized for use by the Client
> I, the Artist strive to perform to the best of their ability in good faith and warrant commissions are 100% original according to the Artist’s best knowledge
> I have the right to decline any request and commissions
> I may stream and post your commission progress and artwork on my social media platforms, Client is required to tell me, the Artist, if they would like me to keep progress hidden and only post the final productCONTENT RESTRICTIONS
> I will not create content that is explicit, offensive, or inappropriate
> Specific restrictions include but are not limited to furries, mecha, full NSFW, underage characters, copied styles, realistic and gender identities or cultures that I may not be able to portray authentically
> I am open to drawing humans with animal characteristics and slight NSFW
> DO NOT use my artwork to create or train AI and NFTs
> DO NOT edit, trace, or modify any of my artwork without my permissionREVISIONS
> 2 revisions allowed per item shown to the Client during the sketching process
> After line art, only minor revisions are allowed
> Extra revisions will require payment of 3$
> Revisions may affect progress and timelinePROCESS
> Commissions are on a first come first serve basis unless you have set a deadline
> Pricing for the deadline is as follows
>> No deadline, no extra charge
>> Within 2 weeks, +10% of final quote including tax
>> Within 1 week or less than, +20% of the final quote including tax
> Completion of the commission requires 2 weeks minimum and may take up to 8 months depending on each type of commission
> I will converse and recheck your request before starting a sketch/ WIP
> I will provide progress updates and seek for Client's feedback
> Commission will be sent via Google Drive or similar file transfer tools
> If there are any delays and adjustments to the timeline or waiting list, I will inform the Client and update the waiting list website on it
> Please expect delays to occur and remember that waiting on the waitlist could take up to 3 months or more, especially if there are multiple people before youRIGHTS & USAGE
> I retain copyright, ownership, redistribution, and intellectual property rights, which include but is not limited to display, advertising, printing, the art, and WIP on websites, social media, portfolios, streaming platforms, and more
> Client will only use artworks as personal
>> Personal use means: display on social media accounts for promotional purposes with no direct monetization, such as profile pictures, banners, and posts; print and framing in personal spaces; display as part of designs on websites and channels, excluding use in the content of these websites or channels
> Any usage or redistribution of the artwork for profitable activities (both physical and digital), will require the purchase of commercial rights. The fee will vary depending on the commission and the usage
> Client must not claim artworks as their own and must credit me, the Artist, using their social tag/username/link at the instance of display of the artwork or permanently on their websites, social media profiles, streaming platforms and so on

> Client must not edit or modify the artwork in any way without prior permission from me, the Artist
> Usage of artworks for AI tools, learning, platforms, or programs is strictly prohibitedCOMMERCIAL RIGHTS
> Commercial usage rights are not included unless specified in the commission type or listing on the Artist’s websites such as Vtuber models, stream overlays, emotes, and so forth, or as agreed upon
>> Before using any artwork as merchandise, Cilent must inform me for a quotation on commercial pricing. Even if the commission was already paid for without commercial usage
> Commercial rights means usage of artwork on streams, videos, and other content, or any monetized instances, or selling or reselling artwork to another party, as a part of any product such as merchandise
> In the case of character design work for the definition of the Client's brand identity such as character design, logo design, and more, intellectual property rights of the designs and their likeness are exclusively granted to the Client for use, production, and modification purposes, commercial or personal
> Additional charges will be required for commercial usage if not included, typically 2x to 3x of the original costPAYMENTS & FEES
> Full payment should be sent before the Artist starts on your commissions
>> Please contact them ahead of time if you would like to pay a 50% downpayment instead
>> In the case of projects above $200, the final 50% is due at the first complete preview of the final deliverables
> Invoices, proposals, or payment links will be sent to the Client when Artist is ready to begin work. Clients must not send money before these requests for payment from the Artist
> Invoices must be paid within 72 hours, or the project may be delayed or canceled
> Payment is only accepted in USD via Paypal
>> There will be 4% Paypal Tax added to the final payment of all commissions
> Prices may vary or change depending on complexity, requirements, and/or additional requests
> Once Work has begun or payments have been made, the Client acknowledges Work and deliverables are digital and there are no physically shipped goods to receiveCANCELLATION & REFUNDS
> Commissions can only be canceled if Artist hasn't started working on it yet
> No refunds are possible after commissions begin unless initiated by the Artist
